NGT puts interim stay on construction at Chirayu Medical College in Bhopal

Bhopal: The National Green Tribunal (NGT) put an interim stay on all construction activity of Chirayu Foundation near Bairagarh township on Wednesday. It has been alleged that the hospital is violating Bhoj Wetland norms and previous orders passed by the tribunal.

Counsel for petitioner Ajay Sharma, Shantanoo Saxena said, “On April 8, 2013, NGT directed more than 2 acres of land adjacent to boundary of the hospital shall be kept strictly as 'green area' and shall be treated as a 'no-activity zone.' On October 8, 2013, Chirayu Foundation submitted compliance that no further construction would be carried out in the area. However, hospital of the Foundation is now in gross violation of the previous orders of the NGT."

He explained, “The said land under Khasra Nos 70/2/1, 70/2/2 and 70/1/1, was to be treated as part of the hospital project as per orders of NGT. It is a part of Bhoj Wetland and submerged area of Upper Lake. However, environmental clearance (EC) was granted to the project by SEIAA and other authorities thereafter without deliberating upon the very question of Bhoj Wetlands which is amply clear from the 150th minutes of the meeting of SEIAA dated September 26, 2014 wherein even the project distance from Upper Lake (Bhoj Wetland) has not been mentioned or considered.”

Saxena also submitted application before tribunal to implead Central Wetland Regulatory Authority and Ministry of Environment and Forests (MoEF) in the matter. Next hearing will be on September 30.

Around 50 advocates of NGT Bar Association will abstain court on Thursday in protest of an altercation that took place during the course of Chirayu hearing between advocate Ajay Gupta and judicial member Justice Dalip Singh. “We will abstain from work for not following procedures of law as per NGT Act,” said president of association advocate Sachin Verma.
